Why E?

I do not see much context to support answer choice E. I chose B and I see why that is wrong because there isn't any context about what rainfall was like world wide except for the part where the passage says "water resources dwindling." But I just don't see where we would know that content for the draft articles had already been articulated.

    Not an instructor here and I also had a similar question. I think the beginning of 2nd paragraph does suggest that the Draft is manifested in"past legal decisions" regarding the issue. However, I still don't know where we can draw that "much of content" had been articulated by the court? I hope this helps a little...

    Lines 19-22 tell us that Most of the treaty was existing court decisions, and the treaty was codifying it into law rather than just precedent.
