Can someone explain why E is incorrect?

Answers E and B seem very similar to me and both seem supported by the text. The text talks about the fact that the court ruled that it was not abandoned property so would they not of had to ask the question in E?

    Just kidding. After re reading it about 50 times I realize E is talking about the property the buried objects were on not about the buried objects themselves... Fell for the trap answer... smh.
