The issue with answer choice (A) is that the passage is not really focused on the debate of legal indeterminacy, i.e. realists v. current legal scholars. It's really only focused on indeterminacy from the viewpoint of the realists. The first paragraph introduces the idea of indeterminacy and how the realists look at it in the law. The second paragraph expounds on the realists' belief of indeterminacy in the decision of any litigated case. And the third paragraph discusses the realists' views on the decisions of judges.
Therefore, a better title for the passage would be answer choice (D): "Legal Indeterminacy: The Realist's View of its Scope."
